In accordance with the "Notice of the General Office of the Provincial Government on Printing and Distributing the Measures for the Administration of Energy Savings Transactions of Jiangsu Province (Trial)" (Su Zheng Ban Fa [2015] No. 27), and in accordance with the principle of simplifying procedures and improving efficiency, these Rules are formulated. In order to clarify the relevant procedures and specific requirements, ensure that the project energy conservation transaction work is carried out smoothly.
First, the transaction process
See the flow chart (Annex 1) for details.
Second, the project energy saving audit commission
1. Projects commissioned by third-party organizations to review energy conservation shall comply with the requirements stipulated in the “Administrative Measures for Energy Savings Transactions of Jiangsu Province (Trial)” (hereinafter referred to as “Measures”). The energy-saving renovation project involves expanding the production capacity specifications of the process equipment. When calculating the energy-saving quantity of the project, the energy consumption increased due to the expansion of the production capacity due to the expansion of the process equipment specifications shall be deducted; the energy-saving capacity of the equipment for eliminating backward production capacity shall be based on the actual production three years before the elimination. Energy consumption is calculated by the energy consumption situation.
2. The energy-using renovation project and the energy-using unit that has eliminated the production equipment (owner of energy-saving capacity) shall entrust the authorized third-party auditing agency of the project energy-saving transaction in Jiangsu Province within the prescribed time limit (see the official website of Jiangsu Energy Savings Trading Center). The energy saving amount is on-site audit.
3. Entrust a third-party organization to conduct energy-saving audits, and submit an energy-savings audit application form and related materials to third-party organizations (see Annex 2).
4. When submitting the energy conservation audit application form, the contract energy management project shall be accompanied by the agreement on the ownership of energy conservation by the two parties; if the energy saving of the production equipment project is rejected by the individual, the ownership certificate of the project shall be attached.
2. Project energy conservation audit, energy saving certificate issuance and information submission
5. Authorized Jiangsu Provincial Project Energy Conservation Transaction Third-party auditing agency shall, after receiving the energy conservation audit, submit a written review of the submitted materials, and meet the requirements, sign an audit agreement with the entrusting party, and conduct on-site audits in a timely manner.
6. The entrusting party shall cooperate with the third party organization to do on-site audit work and provide the materials required for the audit in time according to the requirements of Annex 2.
7. The third party shall review the energy conservation amount according to the “Energy Conservation Quantity Auditing Regulations” (Annex 3), fill out the “Jiangsu Province Energy Savings Site Verification Checklist” (Annex 4), and issue project energy saving to the energy saving right holders for the projects that comply with the “Measures”. Quantity certificate (Annex 5).
8. The third-party organization shall submit the “Energy Savings Certificate” (and its corresponding “Energy Savings Audit Application Form” and “Jiangsu Provincial Project Energy Savings Site On-site Verification Form” to the Provincial Energy Conservation Trading Center within 5 working days after the issuance of the energy saving certificate. The electronic version (word version) and written materials of the “Project Energy Savings Field Audit Report” (see Annex 3).
9. The third-party organization shall submit the registration summary of the energy-saving certificate issuance of the previous month to the provincial energy-saving trading center in the first half of each month (see Annex 6).
Third, the project energy conservation transfer (transaction, gift) and energy saving certificate issued
10. The energy transferee shall negotiate with the transferor holding the valid energy saving certificate through the energy saving certificate information published by the provincial energy saving trading center online platform. After the energy transfer (transaction, gift) has reached the intention of transfer (transaction, gift), fill in the energy-saving transaction form (see Attachment 7), and the transfer parties shall report to the city's economic and trust committee for review.
11. The relevant municipal committees reviewed the energy transfer transfer (transaction, gift). The review included: whether the energy-saving transferor completed the government's energy conservation, total energy consumption and carbon emission control targets, and whether the transferee violated the local government. Management requirements related to total energy consumption control. The transfer of energy savings (transactions, gifts) that does not violate the above requirements should not be prevented.
12. After the energy conservation transfer (transaction, gift) is reviewed and approved by the city's credit bureau, both parties shall submit the energy savings transaction form and related materials (see Annex 8) to the provincial energy conservation trading center for energy saving delivery, and save energy savings. The center shall verify the validity of the relevant materials within 5 working days, issue a new energy saving certificate, cancel the original certificate, and publish relevant information through the online platform.
Fourth, the project energy saving replacement (replacement) use
13. If the energy saving amount of the project is used to replace or replace the energy consumption of the new capacity project, the construction unit shall submit the project energy conservation certificate for the project energy consumption substitution (replacement) to the project evaluation and review department, and the evaluation department shall pass the provincial energy conservation amount. The online platform of the trading center verifies the validity of the certificate and the amount of energy saved. The items used to replace (replace) energy savings and increase energy consumption are not subject to review in principle.
14. The project evaluation and review department shall submit the new energy consumption replacement table (see Annex 9) and the project energy conservation certificate for replacement to the provincial energy conservation trading center within seven working days after the project can be evaluated and approved. The Provincial Energy Conservation Trading Center will cancel the project energy saving certificate for energy consumption replacement and release information through the online platform.
15. The energy saving amount of the project is used to replace the energy consumption of new capacity projects, and after the replacement, the remaining energy saving is above 100 tons of standard coal (inclusive), and the provincial energy saving trading center will issue a new energy saving certificate to the energy saving owner according to the remaining energy saving amount. And publish information through the online platform.
V. Energy Savings Trading Online Information Management
16. All information of project energy conservation certificate, energy saving transaction and energy saving use are uniformly released by the provincial energy saving trading center through the online platform.
17. In the process of transaction transfer and alternative use, the relevant parties should understand and verify the validity of the energy-saving certificate and the amount of energy-saving through the online information platform to prevent fraud, deception and other acts.
18. The provincial energy-saving trading center shall timely release relevant information on the project energy-saving certificate, energy-saving trading, and energy-saving certificate to ensure the timely and authoritative online information.
6. Supervision and management
19. The Provincial Energy Savings Trading Center set up a report phone to accept supervision of the authenticity, compliance and energy saving audits of energy-saving projects, energy-saving trading, and energy-saving use.
20. The Provincial Economic and Information Technology Commission and the relevant departments shall, through the organization of experts, energy conservation supervisory agencies, entrusted third-party agencies or local competent authorities, conduct investigations and verifications on violations of suspected fraud, and punish the violations according to relevant regulations.
