According to the "Energy Conservation Law of the People's Republic of China" and the "Decision of the State Council on Strengthening Energy Conservation Work" (Guo Fa [2006] No. 28) and the "Notice of the State Council on Printing and Distributing the Comprehensive Work Plan for Energy Conservation and Emission Reduction" (Guo Fa [2007] 15 No.) and other documents, in order to speed up the implementation of contract energy management and promote the development of energy-saving service industry, the following comments are made:
First, fully understand the importance of implementing contract energy management and developing energy-saving service industries
Contract energy management is a service mechanism that is widely promoted in developed countries and uses market means to promote energy conservation. The energy-saving service company signs energy management contracts with users to provide users with energy-saving diagnosis, financing, transformation and other services, and recovers investment and obtains reasonable profits by means of energy-saving benefit sharing, which can greatly reduce the capital and technical risks of energy-saving renovation of energy-using units. It is an effective energy-saving measure to mobilize the enthusiasm of energy-saving renovation of energy-using units. Since the introduction of the contract energy management mechanism in the late 1990s, China's energy-saving service industry has developed rapidly through demonstration, guidance and promotion. The number of specialized energy-saving service companies has increased, and the scope of services has expanded to include industrial, construction, transportation, and public institutions. Fields. In 2009, there were 502 national energy-saving service companies, with a total output value of more than 58 billion yuan, and an annual energy-saving capacity of 13.5 million tons of standard coal, which played a positive role in promoting energy-saving renovation, reducing energy consumption and increasing social employment. However, we must also see that China's contract energy management has not received sufficient attention. The energy-saving service industry still has outstanding problems such as fewer fiscal and taxation support policies, financing difficulties, small scale, and unregulated development. It is difficult to adapt to the needs of the development of energy-saving work. Accelerating the implementation of contract energy management and actively developing energy-saving service industries is a powerful measure to use market mechanisms to promote energy conservation and emission reduction and reduce greenhouse gas emissions. It is an urgent requirement for cultivating strategic emerging industries and forming new economic growth points. The objective needs of a type and environment-friendly society. All regions and departments must fully understand the importance of implementing contract energy management and developing energy-saving service industries, and take practical and effective measures to create a favorable policy environment and accelerate the development of energy-saving service industries.
Second, guiding ideology, basic principles and development goals
(1) Guiding ideology.
Hold high the great banner of socialism with Chinese characteristics, take Deng Xiaoping Theory and the important thinking of the 'Three Represents' as the guide, thoroughly implement the scientific development concept, give full play to the role of the market mechanism, strengthen policy support and guidance, actively implement contract energy management, and accelerate new energy conservation Promote the application of technology and new products, promote the development of energy-saving service industries, and continuously improve energy efficiency.
(2) Basic principles.
The first is to persist in the role of the market mechanism. Give full play to the basic role of market allocation resources, build a market-oriented energy-saving service mechanism based on sharing energy-saving benefits, and promote energy-saving service companies to strengthen technological innovation and service innovation, improve service capabilities, and improve service quality.
The second is to strengthen policy support and guidance. Through the formulation and improvement of incentive policies, strengthen industry supervision, strengthen industry self-discipline, create a policy environment and market environment conducive to the development of energy-saving service industries, and guide the healthy development of energy-saving service industries.
(3) Development goals.
By 2012, we will support the cultivation of a group of specialized energy-saving service companies, develop and expand a number of comprehensive large-scale energy-saving service companies, and establish a market with energy-saving, distinctive features and standardized and orderly energy-saving services. By 2015, a relatively complete energy-saving service system will be established, professional energy-saving service companies will further expand, service capabilities will be further enhanced, service areas will be further broadened, and contract energy management will become one of the main ways for energy-saving renovations by energy-using units.
Third, improve the policy measures to promote the development of energy-saving service industry
(1) Increase funding support.
The contract energy management project shall be included in the central budgetary investment and the central financial energy conservation and emission reduction special fund support scope, and the energy conservation transformation project implemented by the energy conservation service company adopting the contract energy management method shall meet the relevant regulations and be given financial subsidies or rewards. Where conditions permit, we must also arrange certain funds to support and guide the development of the energy-saving service industry.
(2) Implementing a tax support policy.
Under the premise of strengthening tax collection and management, appropriate tax support policies will be adopted for the energy conservation service industry.
First, the implementation of contract energy management projects for energy-saving service companies, the business taxable income obtained, temporarily exempted from business tax, and the assets formed by the contract energy management project for the free transfer to the energy-using units are exempt from VAT.
Second, the energy conservation service company implements the contract energy management project, which complies with the relevant provisions of the tax law. From the tax year in which the first production and operation income of the project belongs, the first to third years are exempted from corporate income tax, and the fourth to sixth years Reduce the corporate income tax by half.
Third, the reasonable expenses that the energy-using enterprises actually pay to the energy-saving service companies in accordance with the energy management contract can be deducted when calculating the current taxable income, and no longer distinguish between service fees and asset prices for tax treatment.
Fourth, after the expiration of the energy management contract, the assets that the energy conservation service company transfers to the energy-using enterprise due to the implementation of the contract energy management project shall be taxed according to the assets with the depreciation or amortization period. When an energy-saving service company and an energy-using enterprise handle the transfer of ownership of the above-mentioned assets, they will not be separately included in the income of the energy-saving service company.
The specific implementation measures for the above-mentioned taxation policies shall be formulated separately by the Ministry of Finance and the State Administration of Taxation in conjunction with the Development and Reform Commission and other departments.
(3) Improve relevant accounting systems.
Government agencies at all levels use contract energy management methods to implement energy-saving retrofits, and expenditures paid to energy-saving service companies in accordance with contracts are treated as energy costs. The public institution adopts the contract energy management method to implement energy-saving renovation, and the expenses paid to the energy-saving service company according to the contract are included in the relevant expenditure. Enterprises adopt contract energy management methods to implement energy-saving renovation. If the acquisition, construction and acceptance of services can be reasonably distinguished and measured separately, they should be accounted for separately and processed according to the national unified accounting standards system; if they cannot be reasonably distinguished or can be distinguished but cannot be separated In the case of measurement, the expenses actually paid by the enterprise to the energy-saving service company are expensed. When the energy management contract expires, the energy-using unit obtains the relevant assets as the acceptance of the donation, and the energy-saving service company treats it as a gift.
(4) Further improve financial services.
Banks and other financial institutions are encouraged to innovate credit products according to the characteristics of financing needs of energy-saving service companies, broaden the scope of collateral, simplify application and approval procedures, and provide financial services such as project financing and factoring for energy-saving service companies. The fixed assets invested by the energy conservation service company in implementing the contract energy management project may apply to the bank for mortgage loans in accordance with relevant regulations. Actively use foreign concessional loans and grants to increase support for contract energy management projects.
Fourth, strengthen guidance and services for the development of energy-saving service industries
(1) Encourage and support energy-saving service companies to become bigger and stronger.
Energy-saving service companies should strengthen service innovation, strengthen personnel training, strengthen technology research and development, strengthen brand building, and continuously improve comprehensive strength and market competitiveness. Encourage energy-saving service companies to implement large-scale, brand-based and network-based operations through mergers, joints, and restructurings, and form a group of large-scale service enterprises with well-known brands and strong competitiveness. Encourage large-scale key energy-using units to use their technological advantages and management experience to form specialized energy-saving service companies to provide energy-saving services for other energy-using units in the industry.
(2) Give play to the service and self-discipline of industry organizations.
Energy-saving service industry organizations should give full play to their functions, vigorously carry out business training, speed up the construction of information exchange platform, timely summarize and promote the successful experience of energy-saving service companies with outstanding performance, and actively carry out energy-saving consulting services. It is necessary to formulate an energy conservation service industry convention, establish and improve the industry self-discipline mechanism, and improve the overall quality of the industry.
(3) Creating a good environment for the development of energy-saving service industries.
Local people's governments at all levels should put the implementation of contract energy management and development of energy-saving service industries on the important agenda, strengthen leadership, and organize carefully to achieve practical results. Government agencies should take the lead in adopting contract energy management methods to implement energy-saving renovations and play a model role. The energy-saving competent departments at all levels should adopt various forms to widely publicize the important significance and obvious results of contract energy management, improve the awareness and identity of the whole society on contract energy management, and create a favorable atmosphere for implementing contract energy management. It is necessary to strengthen the use of energy metering management, and urge energy-using units to allocate energy metering equipment according to regulations, and provide basic conditions for energy-saving service companies to implement contract energy management projects. It is necessary to organize the implementation of the contract energy management demonstration project to play a guiding and leading role. It is necessary to strengthen research on the development law of energy-saving service industry, actively learn from foreign advanced experience and beneficial practices, coordinate and solve difficulties and problems in industrial development, and promote the sustainable and healthy development of the industry.
